1. Scope
These terms of service apply to the use of the Yabino website and platform (hereinafter "Yabino", "we"), a multilingual directory of local businesses. Details about the operator can be found in the imprint. By registering an account or using our features, you agree to these terms.
2. Description of services
Yabino operates an online directory of local businesses with search, map view, review, and favorites features. We provide the technical platform; the accuracy, completeness, and timeliness of information provided by businesses is the responsibility of the respective businesses.
3. Registration and user account
Certain features (reviews, favorites, managing business listings) require registration. You are obliged to provide truthful information when registering and to keep your login credentials confidential. You are responsible for any activity carried out using your login credentials, to the extent you are responsible for any misuse.
4. User obligations
When using Yabino, you agree in particular to:
- not provide false, misleading, or unlawful information,
- only submit reviews based on your own genuine experience,
- not post offensive, discriminatory, or unlawful content,
- not impair the platform through automated access, scraping, or comparable methods,
- comply with applicable law and the rights of third parties (in particular personality, trademark, and copyright rights).
5. Business listings and third-party content
Business listings may be researched and added by us, or created and managed by businesses themselves. We do not guarantee the accuracy, completeness, or timeliness of content provided by businesses or other users. We reserve the right to review, edit, or remove listings that violate these terms.
6. Claiming and verifying business listings
Business owners can claim a listing that we created via the claim feature, submitting information and optionally a document to prove their entitlement. We review incoming claims at our own discretion and may reject them without giving reasons, for example in case of doubts about the claimant's entitlement.
Once a claim is approved, the respective business listing is assigned to the claiming account and marked as verified. Providing false information when claiming a business listing may result in the claim being rejected and the user account being suspended.
7. Reviews and user content
By submitting a review or other content, you grant us the necessary, non-exclusive right to display that content publicly as part of operating Yabino. You can edit or remove your own reviews at any time via your user account. We reserve the right to remove reviews that violate section 4 of these terms.
8. Intellectual property
All content on Yabino, in particular layout, software, logos, and editorial content not provided by users or businesses, is protected by copyright. Any use beyond the intended use of the platform requires our prior written consent.
9. Limitation of liability
We are liable without limitation for intent and gross negligence, as well as under the German Product Liability Act. In the event of slightly negligent breach of material contractual obligations (cardinal obligations), liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slightly negligent breaches of duty is excluded. The above limitations of liability do not apply to injury to life, body, or health.
We assume no liability for the accuracy of content provided by businesses or users (e.g. opening hours, addresses, reviews).
10. Suspension and termination of accounts
We may temporarily suspend or permanently delete user accounts in the event of a violation of these terms. You may have your account deleted at any time via your account settings or by contacting us.
11. Changes to these terms
We may amend these terms with future effect to the extent necessary to adapt to changed legal or technical circumstances. We will inform registered users of material changes in an appropriate manner.
12. Governing law and jurisdiction
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.
13. Dispute resolution
We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
